This Privacy Policy explains how AJAW Technologies Inc. ("AJAW," "we," "us," or "our") collects, uses, shares, and protects information when you visit ajaw.ai, use our software-as-a-service platform, communicate with us, or otherwise interact with our products and services (collectively, the "Services").

1. About AJAW & Scope of This Policy

AJAW Technologies Inc. provides AI-powered business automation software, including client follow-up systems, prospecting and outreach tools, AI receptionist services, funnel and landing-page builders, and related integrations with third-party messaging and advertising platforms.

This Policy applies to:

  • Visitors to ajaw.ai and any AJAW-operated subdomain or marketing site;

  • Customers and authorized users of the AJAW platform;

  • Prospects who interact with us through forms, demos, email, SMS, or messaging channels (including WhatsApp and Instagram);

  • End users whose information is processed through AJAW Services on behalf of our customers (see Section 16).

This Policy does not apply to third-party websites, services, or integrations that we do not own or control, even if they are linked from our Services.

2. Information We Collect

2.1 Information You Provide Directly

  • Account & profile data: name, email address, phone number, business name, role/title, password, billing address.

  • Payment information: processed by our payment processors (e.g., Stripe). We do not store full credit card numbers on our servers.

  • Communications: messages you send us via email, contact forms, chat, Loom replies, demo requests, calendar bookings, and customer support tickets.

  • Content you upload: prospect lists, CRM data, business documents, scripts, prompts, brand assets, audio recordings, and any other content you submit to the Services.

  • Survey & feedback responses when you choose to participate.

2.2 Information Collected Automatically

  • Device & technical data: IP address, browser type and version, operating system, device identifiers, screen resolution, language preferences.

  • Usage data: pages viewed, features used, clicks, session duration, referring URLs, timestamps, error logs, and performance metrics.

  • Cookies and similar technologies (see Section 7).

2.3 Information from Third Parties

  • OAuth and connected accounts: when you connect a Google, Meta (Facebook/Instagram), WhatsApp Business, or other third-party account, we receive the data you authorize that platform to share with us.

  • Advertising platforms: aggregated ad performance data from Meta Ads, Google Ads, TikTok Ads, and similar platforms when you connect those accounts.

  • Enrichment & prospecting data providers: publicly available business contact information used by our outreach tools.

  • Service providers and partners who help us deliver, secure, and improve the Services.

2.4 Information We Do Not Knowingly Collect

We do not knowingly collect government-issued ID numbers, full payment card numbers, biometric data, precise geolocation, or sensitive categories of personal data (such as health, racial or ethnic origin, religion, sexual orientation, or political opinions) unless a customer chooses to upload such content into the Services. Customers are responsible for ensuring they have the legal right to do so (see Section 16).

3. How We Use Information

We use the information we collect to:

  • Provide, operate, maintain, and secure the Services;

  • Authenticate users and manage accounts, subscriptions, and billing;

  • Train, configure, and run AI features that you have explicitly enabled (such as AI follow-up, AI receptionist, and funnel generation);

  • Send transactional messages, service notifications, and security alerts;

  • Provide customer support and respond to inquiries;

  • Send marketing and promotional communications (you can unsubscribe at any time);

  • Analyze usage to improve features, fix bugs, and develop new products;

  • Detect, investigate, and prevent fraud, abuse, spam, or violations of our Terms of Service;

  • Comply with legal obligations, enforce our agreements, and protect the rights, property, or safety of AJAW, our users, or others.

We do not sell personal information. We do not use your business data, prospect lists, or end-customer data to train general-purpose AI models for use outside of your account.

4. Legal Bases for Processing (GDPR)

If you are in the European Economic Area, the United Kingdom, or Switzerland, we process personal data on the following legal bases:

5. How We Share Information

We share information only as described below:

  • Service providers: hosting (e.g., Hostinger VPS, AWS), email delivery, analytics, payment processing, customer support, and similar vendors that process data on our behalf under written agreements.

  • AI sub-processors: we use third-party AI APIs (such as Anthropic Claude, OpenAI, ElevenLabs) to power AI features. Inputs sent to these APIs are governed by the providers' own data policies and, where applicable, no-training and zero-data-retention configurations.

  • Connected platforms: when you authorize an integration (e.g., Meta, WhatsApp, Google, TikTok, Stripe), we share data with that platform as necessary to perform the integration.

  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

  • Legal & safety: to comply with applicable law, lawful requests from public authorities, court orders, or to protect rights, safety, and property.

  • With your consent: for any purpose disclosed at the time of collection.

6. Third-Party Platforms

6.1 Meta Platforms (Facebook, Instagram, WhatsApp)

AJAW integrates with Meta-owned platforms. When you connect a Meta account, we access only the permissions you explicitly grant. Use of information received from Meta APIs adheres to the Meta Platform Terms and Developer Policies, including limited use requirements.

For WhatsApp Business API integrations: messages, templates, and contact information are processed solely to provide messaging services you have configured and are not used for unrelated purposes.

6.2 Google Services

AJAW's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We do not use Google user data to train generalized AI/ML models.

6.3 AI Providers

AI features may transmit your inputs (prompts, documents, contact data, audio) to third-party AI providers strictly for the purpose of generating the requested output. Where supported, we configure these providers' enterprise/zero-retention modes to prevent training on customer data.

6.4 Payment & Other Vendors

Payments are processed by Stripe and similar PCI-compliant providers. We do not store full card numbers.

6.5 SMS Messaging & Mobile Information

Phone numbers and mobile information you provide to AJAW Technologies Inc. through opt-in forms, contact submissions, demo requests, or by directly initiating SMS communication with us are used solely to deliver the SMS messages you have consented to receive from AJAW. These messages may include product demos, onboarding instructions, account updates, appointment and meeting reminders, marketing offers, and customer support communications.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing limited to subcontractors that directly support our delivery of SMS services (such as Twilio Inc., our SMS delivery provider) is permitted as described in Section 5. All other categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

Message frequency varies based on your interactions and may be up to six (6) messages per month. Message and data rates may apply based on your mobile carrier's plan. Carriers are not liable for delayed or undelivered messages.

You may opt out of receiving SMS messages at any time by replying STOP to any message we send. To request help or additional information, reply HELP. We will honor opt-out requests immediately, and you will not receive further messages unless you re-subscribe by providing your consent again through a new opt-in form.

Your consent to receive SMS messages is not required as a condition of purchasing any products or services from AJAW. You may continue using non-SMS aspects of the Services without consenting to SMS.

7. Cookies & Tracking Technologies

We use cookies, local storage, pixels, and similar technologies to:

  • Keep you logged in and remember your preferences;

  • Measure traffic and feature usage (e.g., Google Analytics, server logs);

  • Measure marketing performance (e.g., Meta Pixel, Google Ads tag) on our marketing pages only;

  • Detect and prevent fraud or abuse.

You can control cookies through your browser settings or our cookie banner where displayed. Blocking certain cookies may affect Service functionality.

8. Data Retention

We retain personal data only as long as necessary to fulfill the purposes described in this Policy, including:

  • Account data: for the life of your account plus up to 90 days after deletion (longer where required by law).

  • Customer content: retained while your subscription is active and deleted within 30 days of account termination, unless you request earlier deletion.

  • Billing records: retained for at least 7 years to satisfy tax and accounting obligations.

  • Backups: may persist for up to 90 days after deletion from production systems.

  • Marketing data: retained until you unsubscribe or object.

9. Data Security

We implement administrative, technical, and physical safeguards designed to protect personal data, including:

  • TLS/HTTPS encryption in transit;

  • Encryption at rest for sensitive fields;

  • Role-based access controls and the principle of least privilege;

  • Audit logging and monitoring;

  • Regular vulnerability assessments and patching;

  • Vetted sub-processors bound by written data protection agreements.

No method of transmission or storage is 100% secure. If we become aware of a security incident affecting your personal data, we will notify you and any applicable regulators as required by law.

10. International Data Transfers

AJAW is headquartered in the United States. If you access our Services from outside the U.S., your information may be transferred to, stored, and processed in the U.S. or other countries where our service providers operate. Where required, we rely on Standard Contractual Clauses or other lawful transfer mechanisms.

11. Your Privacy Rights

Subject to applicable law, you may have the right to:

  • Access the personal data we hold about you;

  • Correct inaccurate or incomplete data;

  • Delete your personal data ("right to be forgotten");

  • Restrict or object to certain processing;

  • Receive your data in a portable, machine-readable format;

  • Withdraw consent at any time (where processing is based on consent);

  • Lodge a complaint with a supervisory authority.

To exercise these rights, email privacy@ajaw.ai. We will verify your identity and respond within the timeframe required by law (generally 30–45 days).

12. California Privacy Rights (CCPA/CPRA)

California residents have specific rights under the California Consumer Privacy Act, as amended by the CPRA:

  • Right to know what personal information we collect, use, disclose, and sell or share;

  • Right to delete personal information we collected from you;

  • Right to correct inaccurate personal information;

  • Right to opt out of the sale or sharing of personal information;

  • Right to limit the use of sensitive personal information;

  • Right to non-discrimination for exercising your rights.

We do not sell personal information and do not "share" personal information for cross-context behavioral advertising as those terms are defined under the CCPA, except as may occur through marketing pixels on our public marketing pages, which you can disable through your cookie settings or browser controls.

To exercise California rights: email privacy@ajaw.ai or use our online request form. Authorized agents may submit requests with proof of authorization.

13. European & UK Privacy Rights (GDPR/UK GDPR)

If you are in the EEA, UK, or Switzerland, you have the rights described in Section 11. The data controller for your personal data is AJAW Technologies Inc. You may also lodge a complaint with your local data protection authority.

14. Children's Privacy

The Services are intended for businesses and users 18 years of age or older. We do not knowingly collect personal information from children under 13 (or under 16 in the EEA/UK). If we learn that we have collected such information, we will delete it promptly. Contact privacy@ajaw.ai if you believe a child has provided us personal data.

15. AI & Automated Processing Disclosures

Several AJAW features use artificial intelligence to generate content, suggestions, replies, scoring, and other outputs. You should be aware that:

  • AI-generated outputs may contain errors and should be reviewed before being acted on;

  • You retain responsibility for the accuracy and lawfulness of content you send through AJAW;

  • We do not use customer-uploaded content to train general-purpose AI models;

  • We do not engage in automated decision-making that produces legal or similarly significant effects on you without human involvement, unless explicitly disclosed.

16. Customer Data & Our Role as a Processor

When AJAW customers upload contact lists, CRM data, or end-user information to the Services, AJAW acts as a processor (or "service provider" under the CCPA) and the customer is the controller (or "business"). The customer is responsible for:

  • Having a lawful basis to collect and process that data;

  • Providing required notices and obtaining required consents from end users (including for SMS, WhatsApp, and email outreach);

  • Honoring data subject and consumer requests with respect to their data.

Customers may request a Data Processing Addendum (DPA) by emailing privacy@ajaw.ai.

17. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email (if you have an account) and/or by posting a prominent notice on our website. The "Last Updated" date at the top of this Policy indicates when it was last revised. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
